1. Acceptance of terms

By creating an account or using KickReviews, you agree to these Terms of Service. If you do not agree, do not use the service. These terms apply to all users of KickReviews, including business owners who create accounts and manage customers through the platform.

2. Description of service

KickReviews provides a software platform that allows home service businesses to send SMS review request messages to their customers, collect private feedback, and monitor their Google review performance. The service is provided on a subscription basis.

3. Your responsibilities

By using KickReviews, you agree to:

  • Only add customers who have given you prior express written consent to receive SMS marketing messages, as required by the TCPA
  • Use the service only for legitimate business purposes with real customers
  • Not use the platform to send spam, unsolicited messages, or messages to people who have opted out
  • Keep your account credentials secure and not share them with others
  • Comply with all applicable laws, including the TCPA, CAN-SPAM Act, and FTC guidelines
  • Not use the service in any way that violates Google's review policies

4. Prohibited uses

You may not use KickReviews to:

  • Incentivize customers to leave positive reviews (e.g., offering discounts in exchange for reviews)
  • Filter or gate reviews based on predicted sentiment before directing customers to Google
  • Send messages to people who have not consented to receive SMS from your business
  • Harass, threaten, or abuse your customers
  • Attempt to manipulate or game Google's review system in any way
  • Resell or white-label the service without our written permission

5. Subscription and billing

KickReviews is a paid subscription service. After your free trial period ends, you will be charged the monthly fee for your selected plan. All payments are processed securely through Stripe. You can cancel your subscription at any time from your account settings, and you will retain access until the end of your current billing period.

We reserve the right to change our pricing with at least 30 days' notice to existing subscribers.

6. Money-back guarantee

If you add at least 10 customers during your first 30 days and do not receive any new Google reviews as a result of using KickReviews, you may request a full refund of your first month's subscription fee by emailing hello@kickreviews.ai within 35 days of your first charge. We will process your refund within 5 business days.

7. SMS costs and limits

Each plan includes a monthly SMS allowance. If you exceed your plan's limit, additional SMS may not be sent until the next billing cycle or until you upgrade your plan. Unused SMS do not roll over to the following month.

8. Intellectual property

KickReviews and its original content, features, and functionality are owned by KickReviews and are protected by applicable intellectual property laws. You retain ownership of the customer data you upload to the platform.

9. Limitation of liability

KickReviews is provided “as is” without warranties of any kind. We are not responsible for the content of reviews left by your customers, actions taken by Google regarding your business listing, or any indirect, incidental, or consequential damages arising from your use of the service.

Our total liability to you shall not exceed the amount you paid us in the 3 months prior to the claim.

10. Termination

We reserve the right to suspend or terminate your account immediately if you violate these terms, particularly the TCPA compliance requirements or prohibited uses. You may cancel your account at any time from your dashboard settings.

11. Changes to these terms

We may update these terms from time to time. We will notify you of significant changes by email at least 14 days before they take effect. Continued use of KickReviews after the effective date constitutes acceptance of the updated terms.
